Cheap Auto Insurance in California
Well this one’s going to be kind of a fun page for me. It takes me back 37 years ago. This page is on shopping for low, even cheap auto insurance rates.

Are You Responsible For Business Employees At Your Home?
Many business and home owners assume that the employees of others are covered by workers compensation and that the workers compensation coverage protects them (the business/home owner) from liability should some else’s employee be injured.
This assumption is NOT correct!
Although California, like most states, has what is called an “exclusive remedy” rule which mandates that Workers’ Compensation benefits are the exclusive remedy for employees who are injured on the job, this liability protection does not automatically extend to third parties (i.e. business and home owners).
A Third Party Action Over claim occurs when an injured employee pursues damages from a third party (other than his/her employer). Examples are provided below to show how a home owner (Example 1) and a business owner (Example 2) can be impacted by a third party action over claim.
Example 1: A home owner hires an air conditioning repair person (an employee of the Air Conditioning Repair company) to fix a broken thermostat. The repair person injuries his/herself while in the home by tripping over a child’s toy. The repair person collects from his/her employer’s workers’ compensation policy and files a civil action against the home owner for the same injury.
Example 2: An employee of a plumbing company is working on a jobsite along with a number of other contractors. A framer carrying lumber drops the lumber on the plumber while he is working and injures him. The plumber can collect from workers compensation and pursue civil action against the framer for the same injury.
*In the examples above, even if the employee does not pursue action against the third party, the workers compensation carrier for the employer may elect to subrogate against the third party for their negligence.
There are ways to reduce and/or eliminate one’s exposure to Third Party Action Over liability claims. One of the most common ways of doing so is through contractual risk transfer. Contractual risk transfer is the process of transferring a risk to another party by way of contact; in this case it is transferring the risk associated with a Third Party Action Over liability claim.

Why Do I Need Employment Practice Liability Insurance Policy?

unhappy stressful topic.
Warning!!! This is an upsetting blog about true
things that just shouldn’t be!
EPLI or Employment Practice Liability Insurance is one of those “let’s not talk about it, and hope it goes away topics”!
As a business owner, we all strive to hire qualified employees to work for us. Unfortunately, as you are well aware, not every hiring decision goes as planned. Even if an employee is a good employee and does a great job, or has to be terminated for a legitimate reason such as poor attendance or unsatisfactory work habits every termination opens the door for potential lawsuits. The funny or not so funny thing such as in the example I am sharing with you the terminated “bad employee” wasn’t the one that brought the suit. It was the “good hard working employee”! Many times it is employment practice liability insurance (EPLI) that stands between you, and some things that just shouldn’t be. To make my point check this story out! Unbelievable!
When, a business owner, received a complaint that a sales manager (male employee) made crude, disparaging remarks to a female employee during a trade show, the claim was taken very seriously. An investigation was conducted. During the course of the investigation, the owner spoke with another employee (A good hard working “team member” employee) who witnessed the incident firsthand. According to this employee, the sales manager’s actions were offensive and harassing. Ultimately, after much deliberation, the owner fired the sales manager for his behavior. Even after consulting an Attorney specializing in HR issues during the investigation and before taking action. In other words everything was done right. But here is what happened next!
Weeks later, the (Good hard working team member employee) that witnessed the incident sued the owner for $500,000, claiming that after the incident, the owner had passed her up for promotion and assigned her a poor sales territories, all because she came forward with the details of what happened at the trade show. Although the lawsuit was groundless, the business owner racked up hefty legal bills defending against the allegation. Can you believe that? If not I can give you more examples of how ridiculous this can be.
Lawsuits like the one this business owner faced can come out of left field and are much more common than you’d think. In fact, three out of five employers will be sued by a prospective, current or former employee while they are in business. Does Your Agency Culture SUPPORT or

I recently posted on Social Media one of the COOLEST and most AMAZING compliments our agency has had…

It Has NOT Always Been This Great
I returned to our family’s agency after a 4-year hiatus in May of 2010. I remember vividly walking in about 2 months after my return with my head down and thinking that returning to the insurance industry (specifically the family agency) may well have been the worst career move I could have made. The reason for this thinking was due to the agency’s culture.
To get an idea of the agency culture at the time we need to look at the prior few years that led to the mid-2010 agency I walked in to – in the years leading up to the financial meltdown of 2007/2008 our agency was heavily weighted toward clients in and around the residential construction market. When I went down, so did our revenue and by mid-2010 the agency moral was tapped out and many of the team were on the verge of burnout.
The moral was so bad that I (the owner’s son at the time) didn’t even want to go to work – so how was I supposed to expect our team to be excited about it?
The FIX
I’d love to say that it was by the stroke of intelligence, business savvy, or some other innate quality of mine that we turned our moral (and agency as a whole) around, but honestly it wasn’t my doing.
We started off by having a revolving door of employees for a period of time which luckily led to some really beneficial hires. With these new hires putting their faith in our management we began the arduous task of identifying the “target” for our hiring.
We made the initial mistake of taking too much time filtering and not enough time meeting candidates, once we flipped that over and started meeting them we found the foundation for our winning process.
FIT & ATTITUDE
We then look for qualities and abilities that are aligned with the position we’re looking to fill. And the most important two are ALWAYS: (1) Will they fit with our organization based on their attitude/personality, and (2) are the WILLING to learn?
The BEST Strategy will fall flat without supportive Agency Culture
Our staff now does more than they ever have and routinely surpass the plans we as ownership put forth and base our agency goals upon.
Now that our Agency Culture is aligned with our Strategy, we’re in a winning mode!
I am thankful for our stellar team and am excited to see where we can go from here.
